The minimum wage will increase as of January 1, 2023
From January 1, 2023, the statutory minimum wage (WML) will increase by 10.15%. What exactly does that mean and does that change also apply to you?
From 21 years
The statutory minimum wage applies to employees aged 21 and over, as of January 1, 2023, is € 1,934.40 per month, € 446.40 per week and € 89.28 per day for a full working week. How complete that working week is –, so 40, 38 or 36 hours – depends on your employer.
Employees with a zero-hour contract, min-max contract and people who continue to work after reaching their state pension age are also entitled to the minimum wage.
< 21 and BBL
Are you under 21 and over 14? Then the minimum youth wage applies. And are you still working and learning via a BBL process? View the minimum wage table BBL 2023 on the central government website. Other minimum wage tables also apply to people on Wajong benefits.
Look further
No matter how old you are and what you are going to do: always be well informed before you start working somewhere. Not only ask about your future salary when you join, but also look at the secondary employment conditions such as the number of days off, any ATV days, a travel allowance, etc.
If you work for an employer through yourself or through BergWerk, you earn at least the legal minimum wage. If there is a higher reward in accordance with the applicable collective labor agreement that the employer in question applies, everyone, including you, will receive this reward. Whether you work there with a permanent contract or no permanent contract.
What is covered by the minimum wage?
These earnings are paid in accordance with minimum wage, unless you have made other arrangements with your employer to
• Your basic salary
• Overtime
• Allowances
• Other awards (such as periodic fixed remuneration, gratuities etc)
And what not?
In addition to your minimum wage, as an employee you are legally entitled to 8% holiday pay. Other additional allowances payable in addition to the minimum wage are
• Expenses
• A performance reward
• A profit distribution
• An end-of-year benefit
• ... or other benefits/fees.
*These compensation is not part of the legal obligation, depends on the relevant secondary employment conditions and/or agreements that you make with your (new) employer.
Fines upon underpayment
Are you underpaid? Speak to your employer about this. The minimum wage is regulated by law and so your employer must adhere to it. This also applies to your holiday allowance. Does an employer not comply with the statutory minimum wage and/or the minimum youth wage? The Dutch Labor Inspectorate (SZW Inspectorate) can then decide to impose a fine.
