Privacy Statement
This is the privacy statement of the private company Berg Werk BV, with its registered office and office in Harderwijk, at Smeepoortstraat 18, hereinafter referred to as: BergWerk.
Applicability
This privacy statement applies to all privacy-sensitive information or personal data that you provide to us in any form (letter, e-mail, contact form, SMS, WhatsApp, etc.). We attach great importance to the privacy of our (flex) employees, candidates, counterparties and debtors, as well as third parties engaged by us, and therefore exercise the utmost care in handling and protecting personal data. We process data in accordance with the conditions set in the General Data Protection Regulation (GDPR). BergWerk is the controller within the meaning of the GDPR with regard to the processing of your personal data. This means that only we determine which personal data is processed, for what purpose and in what way. We are responsible for ensuring that your personal data is processed properly and carefully in accordance with the GDPR. In this privacy statement we explain which data we process and for what purposes it is used.
Personal data will be processed from the moment you register and/or register with us. We process data for the implementation of our HR services, including mediation, recruitment & selection, broadcasting, secondment, payroll, payroll administration and personnel management. By using BergWerk services or by visiting the BergWerk website, you agree to this privacy statement.
Overview of personal data
Below you will find an overview of the personal data we process:
- (pre)name, address, place of residence
- email address, telephone number and/or other contact details
- date of birth, sex, nationality
- BSN, and bank account number, copy ID proof
- CV, passport photo, information about training, internship and work experience
- data on availability, employment history and leave
- data that (may) be important in the context of assessing the suitability of the candidate, for example references
- data related to the personnel, salary and absence records
For what purposes do we process your personal data?
- to find suitable vacancies for you
- to mediate between job seekers and employers
- to inform you and communicate with you
- to conclude, execute or terminate an agreement with you
- to comply with legal obligations
- for personnel and payroll administration
- to assess availability and suitability
- for (doing) internal control, operational safety
- for carrying out audits and auditing
Personal data business relationships
BergWerk processes the personal data of data subjects who work for companies with which we do business, to provide offers for and/or provide information about the services and other activities and business relationship, and to conclude and maintain an assignment agreement.
We process the following personal data of business relations:
- contact names, contact details and functions
- business data such as Chamber of Commerce registration, VAT number, payment details and other data that are important when executing the agreement
BergWerk may transfer the personal data obtained from its business relationships if this is necessary to achieve the objectives of the business relationship or for the purpose of mediation. This data may be passed on to applicants or candidates, business partners and subcontractors (e.g. data processors) who provide services on its behalf, and in all other cases where BergWerk may be obliged to do so, for example by a court order or legal judgment.
How long is your information kept?
We do not store your personal data for longer than is strictly necessary. We will keep your data for as long as you want to use our services. We also have obligations to retain data from the laws and regulations.
In the event of employment placement (without having worked for us), your personal data will be kept by us for a maximum of 2 years after the last contact with you.
For applications for permanent/indirect employees (at your own company without employment placement), your data will be kept for a maximum of 4 weeks, unless you have given permission to keep your data for a maximum of 1 year.
You work or will work through us (making it available to a client), then we apply different retention periods for your personal data.
- employment information, application data, screening information, assessment data will be kept for 2 years after the end of your temporary employment/employment contract
- copy ID evidence, employment permits including related documents and payroll tax statements are kept for 5 years after the end of the calendar year of retirement
- reintegration files are kept for 2 years after the termination of the temporary employment/employment contract
- Personal data and documents that are of tax importance are kept for 5 years after loss of the current value
If you are a (potential) business relationship, the following terms will be used:
- personal data and documents that are of tax importance and/or are part of the civil administrative retention obligation that we have as a company (such as agreements, order confirmations, purchase orders) are kept for 5 years after loss of the current value
- (other) contact information is kept for 2 years after the last contact. We may deviate from the periods stated here where necessary (for example in the case of claims) and/or in view of a (divergent) legal obligation
Sharing of personal data with third parties
We may share your personal data with third parties if this is compatible with the purposes mentioned above. Provision to third parties may be necessary for the execution of the agreement we conclude with you, necessary for the representation of a legitimate interest of ours, or necessary to comply with any legal obligation that we may have.
Cookies, or similar techniques, that we use
BergWerk uses technical, functional and analytical cookies that do not infringe your privacy. A cookie is a small text file that is stored on your computer, tablet or smartphone when you first visit this website. The cookies we use are necessary for the technical operation of the website and your ease of use. They ensure that the website works properly and, for example, remember your preference settings. We can also optimize our website with this. You can opt out of cookies by setting your internet browser so that it no longer stores cookies. In addition, you can also delete all information previously stored via your browser settings.
Security
BergWerk does everything it can to optimally protect your personal data against unlawful use. We do this using physical, administrative, organizational and technical measures. Employees of BergWerk, who have access to your personal data, are obliged to make a confidentiality clause. When providing data about you to third parties, we will limit it as much as possible to the minimum or legal obligation. Under no circumstances can BergWerk be held liable for the processing of personal data by a third party.
View, modify or delete data
You have the right to view, correct or delete your personal data. In addition, you have the right to withdraw your consent to data processing or to object to the processing of your personal data by BergWerk and you have the right to data portability. This means that you can submit a request to us to send the personal data we have about you in a computer file to you or another organization mentioned by you. You can send a request for access, correction, deletion, data transfer of your personal data or request for withdrawal of your consent or objection to the processing of your personal data to backoffice@bergwerk.nu. To ensure that the request for access has been made by you, we ask you to send a copy of your ID with the request. In this copy, make your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Social Security Number (BSN) black. This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks.
